Neurology Journals Publishing Agreement
Copyright Assignment/License
a) Author assigns to the American Academy of Neurology (AAN) ownership of all right, title, and interest he or she has in and to the Work, including ownership of the entire copyright in the Work, throughout the world and for the full term of copyright, including any extensions and renewals, in all media now known or later developed.
b) Notwithstanding the foregoing assignment, Author has the right to revise, adapt, prepare derivative works of, present orally, or distribute the Work if such uses are for the Author's personal, noncommercial purposes. Author also reserves any trademark or patent rights to the Work.
If the Work will be made available as open access (e.g., the Work has been funded by Research Councils - UK or Wellcome Trust), the following license applies:
a) Author grants to the American Academy of Neurology (AAN) the exclusive, worldwide, royalty-free, perpetual (for the duration of the applicable copyright) right and license to use the Work for all commercial or educational purposes, including, but not limited to, publishing, reproducing, marketing, distributing (themselves and through distributors), sublicensing, creating derivative works of the Work, and selling copies of the Work throughout the world for the full term of the copyright, including any extensions and renewals, in all media now known or later developed.
b) Corresponding Author will fill out the license to publish and send it to the Journal Editorial Office at journal@neurology.org. That license is incorporated into this agreement by reference.
Author's Representations and Warranties
Author warrants that the Work is an original and unpublished work that is not in the public domain, and that either (1) Author is the copyright owner of the Work and has the sole and exclusive right to grant the rights above, or (2) if the Work is a "work made for hire" (as defined in the Copyright Act of 1976, as amended), Author is an agent of the copyright owner of the Work and is authorized by the copyright owner of the Work to grant the rights above and to agree to the indemnification language below. Further, Author warrants that the Work contains no libelous, obscene, defamatory, or otherwise unlawful material, and does not infringe the copyright or violate any other right of any other party. If excerpts (e.g., figures, tables, and illustrations) from copyrighted works are included in the Work, Author warrants that Author has secured written permission to use those excerpts and has credited the original publication(s) properly. Author further warrants, if applicable, that (i) he or she has obtained valid written authorizations from all patients whose names, photographs, or other protected health information are submitted as part of the Work, and (ii) he or she will maintain such authorizations and inform AAN in a timely manner of any revocation by a patient of such authorization.
Author or, if the Work is a "work made for hire," Author's employer, agrees to indemnify the AAN and its publisher, Wolters Kluwer Health (WKH), and all of AAN's and WKH's officers, directors, employees, and agents, from and against all losses, expenses, damages, claims, or liabilities (including attorneys' fees and costs of litigation) arising from or related to any breach of the covenants, representations, and warranties made by Author in this publishing agreement.
United States Government Employees
If Author prepared (or participated in the preparation of) the Work as part of his or her official duties as an officer or employee of the United States Government, the following limitations apply:
Author cannot and does not agree to (1) transfer copyright to the AAN (if option 1 under the copyright section applies) or (2) indemnify AAN, WKH, and AAN's and WKH's officers, directors, employees, and agents. If option 2 under the copyright section applies, Author grants the license to AAN to the fullest extent he or she is legally able to.
